Terms and Conditions

These terms are in two parts.

Part A applies to everyone who uses our website or our client app. Part B applies when you book a consultation, an itinerary or a tour with us.

By using our website or app, or by paying us a deposit or a fee, you accept these terms.

PART A — WEBSITE AND APP TERMS OF USE

A1. Who we are

A2. Using our website

You may use our website for your own personal, non-commercial use. You may not scrape it, copy it systematically, or use it to build a competing service.

A3. Our content

All content on the website and in the app — text, photographs, itineraries, guides, route plans, design and the Delaney Tours Ireland name and logo — is owned by us or licensed to us and is protected by copyright.

Itineraries and planning documents we prepare for you are for your own personal use on your own trip. You may not resell them, publish them, or pass them to a third party for commercial use.

A4. The “Your Irish Companion” app

  • The app is provided to confirmed clients only, for use in connection with a booked trip.
  • We give you a personal, non-transferable, non-exclusive licence to use it for the duration of your trip and a reasonable period either side.
  • Your account is yours. Do not share your login. Tell us immediately if you think someone else has access.
  • You must not upload anything unlawful, offensive, or that infringes someone else’s rights.
  • The app is a companion, not a substitute for judgement. Route details, timings, opening hours and recommendations may change. Always follow official signage, local instructions and, in an emergency, contact the emergency services on 112 or 999.
  • Access may be suspended or withdrawn if these terms are breached.
  • We may update, change or discontinue features. We do not guarantee uninterrupted or error-free operation.

A5. Deleting your app account

You can delete your account and associated data at any time, from within the app or by contacting us. See our Account Deletion Policy.

A6. Third-party links

Our website and app may link to third-party sites and services. We are not responsible for their content, availability or privacy practices.

A7. Privacy

How we handle your personal information is set out in our Privacy Policy.

PART B — BOOKING TERMS

B1. What we provide

Depending on what you book, we provide:

  • Trip planning consultations — a scheduled call with Vera Delaney
  • Personalised itinerary planning — a bespoke written itinerary and recommendations
  • Private driver-guided touring — a private vehicle, driver-guide, and the agreed route

We do not book or manage your accommodation. We recommend places and you book them directly, in your own name. Where we check availability or make a reservation on your behalf at an attraction, restaurant or venue, we act as an intermediary only and your contract is with that supplier.

B2. Quotations

Quotations are valid for 30 days from the date issued unless we state otherwise in writing. Prices quoted for travel more than 12 months ahead are subject to review and will state their own validity window.

Itineraries marked “proposed, subject to final confirmation and availability” are exactly that. Nothing is confirmed until it is booked and paid.

B3. Booking and payment

  • A booking is confirmed when we receive your deposit of 25% of the total price and we issue written confirmation.
  • The balance is due 30 days before the first day of your tour, unless we agree otherwise in writing.
  • Bookings made inside that window are payable in full at the time of booking.
  • Consultation fees are payable in advance and the call does not go ahead until payment clears.
  • Payments are taken through Square. Prices are in euro. Any bank charges, card fees or currency conversion costs on your side are yours.
  • If the balance is not paid by the due date we may treat the booking as cancelled by you and apply the charges in B4.

B4. If you cancel

Cancellations must be sent to us in writing at delaneytours@gmail.com. The following charges apply from the date we receive them:

Fewer than 15 days, or no-show 100% of total price

Consultation fees and itinerary planning fees are non-refundable once the call has taken place or the itinerary has been delivered, because the work has been done.

Consumer cancellation rights: under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, the 14-day cooling-off period for distance contracts does not apply to contracts for transport, accommodation, car rental, catering or leisure services provided on a specific date or for a specific period. Our tours and scheduled consultations fall into that category.

B5. If we cancel or change something

We plan carefully, but Ireland has weather and roads have works. We reserve the right to alter a route, swap a stop, or change the order of a day where it is necessary for safety, access, weather, traffic or availability. We will always aim to give you something of equal or better value and will tell you as soon as we can.

If we cancel your tour for a reason within our control, you may choose a full refund of everything you have paid us, or an alternative date.

B6. Force majeure

We are not liable for failure to perform where it is caused by events beyond our reasonable control — including severe weather, flooding, strikes, industrial action, road closures, fire, pandemic, government restrictions, civil unrest, or acts of terrorism. In those circumstances we will refund what we can recover from suppliers, less costs already unavoidably incurred.

B7. Travel insurance

Comprehensive travel insurance is a condition of booking. It must cover cancellation, curtailment, medical expenses, repatriation and personal belongings. We strongly recommend arranging it as soon as you pay your deposit. We are not responsible for losses that adequate insurance would have covered.

B8. What’s included and what isn’t

Included: airport collection and return transfer, private driver and touring vehicle for the agreed itinerary, hotel collections and drop-offs, personalised route planning and local recommendations, and flexibility for comfort, weather and reasonable changes.

Paid separately by guests: accommodation, meals and drinks, attraction tickets, guided attraction tours, afternoon tea and other advance reservations, and personal purchases.

Your specific itinerary document sets out anything that differs from this.

B9. Your responsibilities

  • Give us accurate names, contact details, flight times and addresses, and tell us promptly if they change.
  • Tell us at the time of booking about any mobility, medical, dietary or accessibility requirements so we can plan properly. We may not be able to accommodate needs disclosed late.
  • Ensure you hold valid passports, visas and any documentation required to enter Ireland. Immigration requirements are your responsibility.
  • Be ready at agreed pickup times. We will wait a reasonable period; delays may shorten your day.
  • Behave reasonably. We may end a tour without refund where a guest’s behaviour is unsafe, unlawful, or puts others or our driver at risk.
  • Wear seatbelts and follow safety instructions in the vehicle.

B10. Children and minors

Children are welcome. All travellers under 18 must be accompanied by a parent or guardian, who remains responsible for them throughout. Appropriate child seats must be requested at the time of booking.

B11. Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under Irish law — including your rights under the Consumer Rights Act 2022.

Subject to that:

  • We are not liable for the acts or omissions of independent third-party suppliers you contract with directly (accommodation, attractions, restaurants, car hire).
  • We are not liable for indirect or consequential loss, including missed flights, missed connections or loss of enjoyment arising from circumstances outside our control.
  • Where we are liable, our total liability is limited to the amount you paid us for the affected booking.

We hold public liability insurance and appropriate motor and passenger insurance for the vehicles we operate.

B12. Photography

We may take photographs during your tour. We will only use them in our marketing with your consent, and you can withdraw that consent at any time by emailing us.

B13. Complaints

Tell us on the day if something is wrong — most things can be fixed there and then. If you are still unhappy, write to delaneytours@gmail.com within 28 days of your trip ending and we will respond within 14 days.

Nothing here affects your statutory rights. You may also contact the Competition and Consumer Protection Commission (ccpc.ie) or, if you live in another EU country, the European Consumer Centre Ireland (eccireland.ie).

B14. Governing law

These terms are governed by the laws of Ireland, and the courts of Ireland have jurisdiction. If you are a consumer resident in another EU member state, you retain the protection of the mandatory consumer law of your own country.

B15. General

If any provision of these terms is found unenforceable, the rest stands. We may update these terms; the version in force is the one published on our website at the time of your booking.
